Volunteer Liability & Indemnity Release Agreement

This VOLUNTEER RELEASE OF LIABILITY AND INDEMNITY AGREEMENT (the "Agreement") is entered into by "Volunteer" and Ahimsa Safe Haven and its directors, officers, managing agents, employees, insurers, attorneys, agents, representatives and assigns (collectively called "Ahimsa Safe Haven").
1. Volunteer Activities. Volunteer desires to volunteer for Ahimsa Safe Haven, and Ahimsa Safe Haven desires to provide volunteer service opportunities to Volunteer, subject to terms and conditions of this Agreement. Volunteer understands as follows:
1.1 Volunteering on Ahimsa Safe Haven's Shelters/Animal Sanctuaries- Volunteer understands Ahimsa Safe Haven operates a farm that is a sanctuary for animals including turkeys, pigs, chickens, ducks, quail, and cats. Ahimsa Safe Haven also offers tours to the public and provides educational and other outreach programs at its farm. Volunteer activities at this shelter may include providing food and water for animals; cleaning and maintaining the areas where animals are housed; socializing with, handling or being in the presence of animals who may bite, kick, crush or head-butt or have zoonotic diseases; and other cleaning, maintenance, repair, construction, work around downed or live electrical wires, and painting and which may include use of vehicles, tools, power tools, and the operation of equipment; work in or around debris, property that has been damaged or in need of repair, slippery or wet surfaces, falling rocks or tree limbs, uneven or rocky ground or holes or crevices in the road or ground.
1.2 Volunteering at Ahimsa Safe Haven's Business Offices- Ahimsa Safe Haven also operates business offices. Volunteer activities at these offices may include operating or working around heavy equipment and machinery (such as printers, filing cabinets, copy machines, and other furniture, fixtures and machines) or working in areas with electrical wires, and working in or around slippery, wet or uneven surfaces, stairways, and items that may be in need of maintenance or repair.
1.3 Volunteering at Off-Site Events- Ahimsa Safe Haven also conducts events at off-site locations which may include hazardous or dangerous conditions (such as events in public parks, sidewalks and other areas which Ahimsa Safe Haven does not maintain or control).
2. Waiver and Release Volunteer agrees to never bring a claim or suit against and releases Ahimsa Safe Haven and their successors and assigns from liability arising from Volunteer's volunteer activities with Ahimsa Safe Haven.
Volunteer understands this Agreement discharges and releases Ahimsa Safe Haven from any liability to the Volunteer with respect to bodily injury, personal injury, illness, disability, scarring, amputation, death, property damage or other loss that may result as a result of Volunteer's activities at Ahimsa Safe Haven's shelters/animal sanctuaries, offices or other property or any other volunteer activities for Ahimsa Safe Haven.
3. Indemnity Agreement Volunteer agrees to indemnify and hold Ahimsa Safe Haven harmless for all bodily injury, personal injury, illness, disability, scarring, amputation, death, property damage or losses including attorney's fees and costs of litigation that result to anyone else or any other entity because of Volunteer's negligence or liability. This includes lone acts by Volunteer as well as the combined acts of Volunteer with others.
4. Assumption of the Risk Volunteer understands that volunteering for Ahimsa Safe Haven may include activities that may be hazardous and result in injury or damage to Volunteer. This includes, but is not limited to trips and falls, vehicle accidents, contact with downed or live electrical wires, injuries, amputations, or other disabilities from tools, power tools or other farm or office equipment; heavy lifting, back or neck sprain, strain or injuries; cuts, abrasions, broken bones, deafness, blindness, death, handling or being in the presence of animals who may bite, kick, crush or head-butt or have zoonotic diseases. Volunteer understands that activities of Ahimsa Safe Haven may, in some situations, involve inherently dangerous activities.
Volunteer expressly assumes the risk of injury or harm in the conditions and activities described in this Agreement and releases Ahimsa Safe Haven from all liability for bodily injury, personal injury, illness, disabilities, scarring, amputation, death, property damage or other loss resulting from Volunteer's activities at Ahimsa Safe Haven and any other work or activities while volunteering for Ahimsa Safe Haven, including but limited to any such harm suffered as a result of Ahimsa Safe Haven's negligence.
5. Term Volunteer understands that this Agreement is perpetual.
6. Photo and Video release and copyright assignment Volunteer gives Ahimsa Safe Haven a photo, video and sound recording permission to make and use photos, videos, and sound recordings of Volunteer while volunteering for Ahimsa Safe Haven or otherwise being present onAhimsa Safe Haven property. Volunteer releases all rights in such photos, videos, and sound recordings and agrees Ahimsa Safe Haven may use such photos, videos, and sound recordings to further the mission of Ahimsa Safe Haven, promote its activities and goals, for fundraising and otherwise as Ahimsa Safe Haven deems appropriate in its sole discretion and without any compensation to Volunteer. Volunteer gives Ahimsa Safe Haven an assignment of copyrights to any photos, videos or sound recording taken by Volunteer while participating at a Ahimsa Safe Haven event where those photos, videos or sound recordings taken by Volunteer while participating at a Ahimsa Safe Haven event where those photos, videos, or sound recordings have been delivered to Ahimsa Safe Haven by Volunteer.
7. Miscellaneous This Agreement shall be governed by and interpreted in accordance with the laws where volunteer is performing volunteer activities for Ahimsa Safe Haven. Volunteer agrees that in the event that any clause or provision of this Agreement shall be held to be invalid by any court or competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement.
8. Acknowledgment of Understanding and Intent Volunteer represents that they have read this Agreement and fully understands it is a release and indemnity agreement. Volunteer further represents that they are of legal age and legally competent to execute this Agreement and that the Volunteer does so of their own free will. Volunteer has not relied on any representation of any kind or character not contained in this Agreement. Volunteer expressly agrees that this Agreement is intended to be as broad and inclusive as permitted by law.
By checking the box below, Volunteer agrees to the term of this Agreement and understands that Volunteer is giving up substantial rights, including the right to sue and recover damages. Volunteer intends their agreement (via checking the box and submitting this application) to be a complete and unconditional release of all liability to the greatest extent allowed by law.
